公共服务型政府与计划法律制度的建设——围绕“十一·五国民经济和社会发展规划”谈起

管制性政府向公共服务型政府的转变是一个全方位多层次的系统工程,其中计划法律制度的建设是不可忽略的重要方面.特别是国民经济和社会发展规划的制定和执行,在我国经济、社会和文化建设中有着举足轻重的地位,政府在规划的制定、执行中的地位和作用的转变正是公共服务理念的体现.只有将五年规划的编制和实施纳入法律程序,使其内容反映市场经济规律的要求,与公共服务型政府的角色相适应,才能为和谐社会的构建提供总体方向的指引.另外,与公共服务型政府职能相适应的计划实体法律制度和程序蝌法律制度的建立也需要引起学界的重视.

Public Service Government and Improvement of Planning Law——Discussion on "The Eleventh Five-year Plan of National Economy and Society Development"

In the process of conversion from traditional government to service government, synthetic administrative system should be built including the consummation of administrative law related. Recent years, quite a few experts hold the position that we did not need any kind of planning law at all. However, this article takes the opposite opinion that we should not only emphasize the function of planning law in the whole legal system, but also find the proper way to improve the material items of this law. Actually, the Plan of Economic and Society Development in China , which is the most important part of planning law, is so significant that any other rules or documents can fluctuate its position nowadays. The article also illustrates several critical issues in enacting and enforcing of the plan in order to supply a gap of existing system.
