中国技术移民立法问题探讨

技术移民是各国人力资源竞争的重要对象。中国财智外流严重的现状以及不完善的技术移民法律法规都影响了国际技术人才来华工作的积极性。通过欧美等发达移民国家的技术移民法律与政策的比较,结合中国新出台的《出入境管理法》,有必要在出入境管理制度、永久居留权等方面进行法理创新,建议适时制定符合中国国情的技术移民法律法规,并且增加"人才引进"类别签证,从而吸引更多的高层次海外优秀人才。

On the Legislative Problems about Skilled Migrants in China

Skilled migrants have become important objects for the war of grabbing human resources in various countries.The situation of money and intelligent outflowing from China and the defect of Chinese laws and rules for skilled migrants chill the enthusiasm of the foreign skilled works entering China.Based on comparative study of skilled migrants law or policies in some countries in Europe and America,the authors think it is necessary to discuss prudently the legislation on skilled migrants in China.As new Entry and Exit Administration of PRC will be soon promulgated,the authors suggest that Chinese government should make several rules or laws on skilled migrants to attract the high skilled migrants from other countries,based on the current condition as well as legislative problems discussed on aliens entry & exit control and rights of permanent residence.
