摘    要:建筑物区分所有人共有权,是指建筑物区分所有人按照法律或者依据约定,对区分所有建筑物中不属于各业主单独所有的共有部分所享有的占有、使用、收益以及一定程度上的处分权。该共有权具有多重性、从属性、不可分性的特征,其性质应该按份共有,其客体范围的确定具复杂性,共有人权利和义务具有不同于一般共有的特点。

Abstract:By clarifying the common proprietary rights of owners of constructions, we mean to distinguish between the rights of possession, use, benefit and punishment to a certain degree that owners of the construction have on the parts of the construction that they do not possess alone but share. Such common proprietary rights are multiple ,subordinate, inseparable and to be shared. It' s complicated to define the scope of their object. The rights and obligations of the common owners have their particular features.
