| 摘 要： | 形上理性权利观是西方权利正当性观念中最为核心的理论流派。这一观念理论以抽象的方式表达出对权利至上性的信仰,通过强调理性的决定作用,主张理性是权利的最高准则,权利的正当与否,取决于是否与理性相一致。康德与黑格尔为这一观念提出了本体论的证明方式,其理论特质为权利具有神圣性和不容置疑性;权利具有决定性;权利具有合乎道德性。形上理性权利观主要表现在近代以来的西方宪政实践和法律的价值观念中。
