| 摘 要： | 从法与社会相互作用的法律社会学之视角对唐代长安市法进行梳理。分析认为,公元7世纪前后的唐都长安,已经具备了相当完备的对城市市场和贸易进行管理的市法规范,使得市场的设置,货物的价格、质量,商税等莫不有法式,从而推动了市场规模的发展和繁荣。同时认为,长安市法虽然在一定程度上发挥了市场管理、规范的作用,但是封建制度下国家的过分介入和干预导致市场主体自由的缺失,使长安市法也成为商品经济发展的障碍。

| Abstract: | Chang＇an City in Tang Dynasty,around the 7th century AD,is the world＇s influential inter-national city.Its commercial trade connected the east to the west,and its Marketing law,as a guarantee,resulted in the long-term stability and prosperity.However,under the feudal system,the over inter-ferences from the governments also led to the deficiency of market body freedom and restrained the further economic development at that time. |
