个人信息转移权客体范围和实现方式的反思与修正

《个人信息保护法》确立了个人信息转移权，该权被赋予促进个人信息流通、打破数据平台垄断的期待。然而，作为新兴权利的个人信息转移权在实践中面临着客体范围模糊、操作性不强等主要问题，这导致个人信息转移权落地困难。在剖析困境成因、比较域外立法经验和反思实践成效的基础上，建议将直接数据和部分观察数据纳入个人信息转移权客体范畴，确定差异化数据传输要求，以期实现个人信息转移权的多重效能。

Reflection and Revision on the Object Boundary and Realization Method of the Right to Information Portability

The right of information portability has been established in the Personal Information Protection Law. Information portability is expected to promote the circulation of personal information and break the monopoly of data platforms. However, as a new right, the main problem of the right to information portability in practice is that the object scope is fuzzy and the operation is not strong. As a result, these issues have led to poor practice of the right to information portability. On the basis of analyzing the causes of the predicament, comparing foreign legislative experience and reflecting on the effectiveness of practice, we recommend that, first of all, direct data and partial observation data should be included in the scope of object of the right of information portability. Second, differentiated data transmission should be clarified. Finally, the multiple values of information portability will be realized.
