| 摘 要： | 随着两大法系法律制度的日趋融合,行政判例制度在两大法系的法律制度中都被采纳,并在行政领域发挥着重要的作用.从比较法的角度出发,分析两大法系中行政判例制度的兴起、发展、创制、效力,并结合我国的现状,试图构建我国的行政判例制度.

| Abstract: | With the integration of the two legal systems,the administrative precedent system is accepted in the two legal systems'legal regimes,and is playing the vital role in the administrative domain.This paper analyzes the rise,development,formulation and the potency of the administrative precedent system from the angle of comparative law in an attempt to construct the present administrative precedent system in China. |
