| 摘 要： | 审判公开作为现代诉讼中的一项重要制度,其产生绝非偶然,而是有着深厚的理论基础的。从民主治国理论上来讲,民主政治的发展要求审判公开;从人权理论上来讲,对公民知情权的保障要求审判公开;从诉讼法理论上来讲,现代刑事诉讼的诉讼目的和诉讼公正的实现以及诸多诉讼原则的贯彻实施要求审判公开。

| Abstract: | Open trial,as an important system in the modern lawsuit,is by no means fortuitous but has deep theoretical foundation.In terms of the theory of managing the country democratically,the development of democratic politics requires opentrial;In terms of the theory of the human right theory,the guarantee of citizens'Knowing right needs open trial;In terms of the theory of law of legal procedure,modern lawsuit purpose and lawsuit just realization and great deal of lawsuit rules also requests open trial. |
