未成年人犯罪的刑事政策完善——基于国际人权公约的分析

未成年人犯罪是当前困扰许多国家的严重社会问题之一,科学地认识进而妥善、有效地解决未成年人犯罪问题,是人类社会所共同面临的课题。对于未成年人犯罪问题,应根据未成年人的特点而采取有别于成年人的一系列制度;既要考虑到预防、打击和治理青少年犯罪的需要,同时要考虑到未成年人的生理、心理特点以及成长的需要,以此体现和追求对人权细微关怀的基本理念。所以,要有效治理未成年犯罪问题,需要变革刑罚,并在传统刑罚制度和刑事诉讼机制之外进行制度创新,借鉴吸收各国成功经验尤其是各地行之有效的实践做法,为建立中国独特的少年刑法、少年司法制度(少年法院、少年法官)奠定理论与实践基础。
