“限娱令”的法理解读

广电总局一系列"限娱令"的出台,引起了广泛的社会争议,特别是限娱令本身的合法性与正当性问题。就实质合法性而言,限娱令有违背法律保留原则之嫌疑,而由于限娱令不符合程序正义和法律公开性的要求,因而并不具备形式合法性。与此同时,限娱令的内容严重侵犯传媒企业的自主经营权,也将严重威胁传媒企业公共责任与新闻自由权利的行使。更为重要的是,限娱令不尊重公民的理性、自治和自尊,干涉了公民的私人领域。

Legitimate Interpretations about the Restrictive Regulations on the TV Entertainment Programms

The issue of a series of restrictive regulations about TV entertainment programms by the State Administration of Radio,Film and Television has aroused in the society a lot of controversies,in particular,the legality and legitimacy of the orders.In terms of essential legality,the order may violate the principle of legal reservation and does not comply with the requirements of procedural justice and judicial publicity,so it is not legally designed.In the meantime,it has infringed the communications enprises′ full authority for management,threatening the realization of their public responsibility and freedom of information.What is worse,the order shows no respect for citizens′ rationality,self-management and self-respect,thus interfering in the private life of citizens.
