论大部制的治理结构与治理机制

面对新时代的挑战，西方国家都进行了大部制改革。十一届全国人大一次会议审议通过的《国务院机构改革方案》表明，我国大部制改革已经起步。其主要内容是按照决策权、执行权、监督权既相互制约又相互协调的要求，理顺职责关系，优化政府组织结构，规范机构设置，实行职能有机统一的大部门体制，完善行政运行机制。笔者以决策、执行、监督相分离为核心的现代公司法人治理结构为基础，全面剖析了大部制的内外部治理结构和治理机制，论述了大部制借鉴现代公司治理模式的意义，以期促进大部制的健康良性运行。

Governance structure and governance mechanism of super-ministry system

To meet the serious challenges of the new era, western countries have introduced the superministry reform. The first meeting of the 11th National People＇s Congress examined and approved of the ＂Institutional Reform Plan of the State Council＂, which indicates that super-ministry reform in China has already started. The main contents of the reform are, in accordance with the requirements of the balance and mutual coordination between the decision-making, executive and supervisory powers, straightening out the relations between different departments, optimizing organizational struc- ture, rationalizing government set-ups, establishing super-ministry of integrated functions, and im- proving the operational mechanism. This article, based on modern corporate governance structure which calls for the separation of decision-making from implementation and monitoring, analyzes the governance structure and governance mechanism of super-ministry system, and discusses the signifi- cance of learning from modern corporate governance system while introducing super-ministry reform, with a view to promoting sound and healthy operation of super-ministry.
