| 摘 要： | 《中华民国临时约法》（１９１２）因具划时代的历史意义而备受推崇，它是我国第一部资产阶级宪法性文件，然而“临时约法”的制定者并未充分考虑到中国当时的实际，终使之成为一纸空文，但从宪法文化上看，“临时约法”的命运反映的是更广阔的文化传统对于“大典”和“朝纲”的处理法则。
