| 摘 要： | 死缓虽然是彰显中国特色的制度设计,但在控制死刑的实际执行上并无特效。相反,死缓的名不副实带来诸多的弊端,导致制度运行的结果是不得其利,反受其害。与其对死缓进行于事无补的改造,不如理性地予以舍弃,这既是法律逻辑的合理展开,也体现了对政治话语的准确理解。

| Abstract: | The system of death sentence with two-year reprieve reflects China's characteristics while is not effective in limiting the actual application of death sentences.Its name falling short of the reality brings about many misadvantages,so it's rather better be abandoned than be modified,which embodies the reasonable deduction of legal logics as well as accurate understanding of political languages. |
