论死缓制度的人道性

死缓制度是否具有人道性,是一个抽象性的问题,也是一个经验性的问题.死缓制度人道与否,不能仅仅通过与死刑立即执行制度对比从而得出肯定的结论,也不能因为其手段严厉而轻易予以否定.衡量死缓制度人道性的标准应为:以民意为视角,判断对罪犯适用死缓能否与犯罪的严重性相称、死缓是否是适合某类罪犯所有的惩罚方式中最轻的一种.目前在我国,从法律、政策、实践等层面予以综合考虑,死缓制度符合民意,符合我国国情,具有人道性.
