| 摘 要： | 在权利的时代话语下,对老年人权利予以宪法上的保障,具有充分的正当性基础。保障老年人基本权利,乃老年人自我生存之需要;对老年人基本权利的保障,乃社会正义之体现;对老年人基本权利的保障,乃维护宪政秩序良性运行之必要条件。各国宪法对老年人基本权利的保障形成了不同的体例和较为统一的权利内容体系。

| Abstract: | When human right is becoming the prevailing utterance of the new era,it is of abundant legitimacy to provide constitutional protection for the aged.Protecting the basic rights of the aged is necessary for the survival of them.Also,it reveals social justice and constitutes some prerequisite conditions for the benign function of constitutional order.For the basic rights protection of the aged,constitutions in different countries have different but relatively substance-consolidated legislation system. |
