| 摘 要： | 对传统知识的法律保护是知识产权保护的国际协调层面面临的新问题。解决这一问题的首要前提是为传统知识法律保护寻求正当的产权基础。洛克财产权理论赖以建立的前提是虚拟的,其内容也与传统知识自身的现实状况和发展规律存在诸多不合;而休谟财产权理论却以其对确立财产权的原因、如何确立财产权以及如何确保财产权的稳定3个问题的回答满足了传统知识法律保护之正当性的要求,成为传统知识法律保护的产权基础的理论依据。
