| 摘 要： | 通过对《送法下乡》一书的考察,可以看出苏力先生理论立场的摇摆不定,其理论前提是一种理论理性的知识观。这种知识观乃是历史法学派在当代中国的一种变型形式,是苏力先生受波斯纳影响之结果。由于苏力先生对此欠缺自觉,他所主张的"本土资源"或者他所界定的"地方性知识观"最终必然因为此一理论前提而无法得到清楚的界定,并且最终违背了他所主张的历史与逻辑相一致的马克思主义分析方法。

| Abstract: | The article points that the ambiguousness of the view-points of Su Li through the analysis of Sending Law to the Countryside:Research on China's basic-level judicial system, and also demonstrated that the epistemology of theoretical reason is it's theoretical basis. The author contents that this kind of epistemology is the variant of historical school in China recently which was received unconsciously through the traslation and introduction of POSNER's theory. It is this methodological instrument that triggers the ambiguity of the native resourses and the so-called local knowledge and also breaks the unity of history and logic of Marxism. |
