摘    要:纠纷的合理解决是和谐社会的表现之一,引发社会纠纷的因素是多方面的,因此解决这些纠纷的途径和方式也应是多方面的。多元化纠纷解决机制就是在以司法诉讼程序为中心的同时,发挥各种非诉讼程序灵活解决纠纷、合理分配司法资源的作用,使各种纠纷解决方法有机的结合在一起,共同发挥作用。我国已拥有以法院调解、仲裁等为主的多种非诉讼纠纷解决程序,并初步形成了一个多元化的纠纷解决机制。但是这些非诉讼程序本身也存在着不足和滞后,因此,对我国现有的非诉讼纠纷解决方式的利弊作出客观评价,在尊重我国国情的基础上探索适合我国的具体模式,才能真正发挥多元化纠纷解决机制对和谐社会秩序构建的促进功能。

Abstract:The equitable settlement of disputes is one of the reflections of the harmonious society. The causes of social disputes are various, and consequently there are a great variety of ways to settle these disputes. The diversifying dispute settlement system centers on the judicial proceedings and integrates various flexible alternative dispute resolutions to make full use of judicial resources. China has set up a variety of alternative dispute resolutions to settle disputes, primarily including mediation and arbitration, etc.. A many - sided dispute settlement system has just come into being. However, there are also drawbacks and lags in these alternative dispute resolutions. Therefore, only by objectively evaluating the advantages and disadvantages of the present alternative dispute resolutions and working out our own specific mode based on China' s national conditions can we bring into full play the function of the many - sided dispute settle- ment system so as to promote the construction of the harmonious society.
