| Abstract: | Since the enactment of the criminal code in 1979,the study of criminal composition in China has had a great expansion in both breadth and depth.However,behind the theoretical flowering in criminal composition,scholars are not consistent with the ontology of criminal constitution,so that the scholars of the criminal law are not in the same level when discussing the problem of criminal constitution,and even talking to themselves.This article first discusses the concept and content of ontology in the field of philosophy,then concludes the exclusiveness and legalization of the ontology of criminal composition.The consistent understanding about the ontology of criminal composition is helpful to the further study of this theory. |
