美德两国违宪审查制度比较研究

为使宪法从名义宪法成为规范宪法 ,建立和完善宪法保障制度尤其是违宪审查制度必不可少。从这一目的出发 ,对美德两国的违宪审查制度在审查主体、审查对象、审查方式、审查时机、审查结果等方面的差异进行了系统的分析 ,并就影响两国违宪审查制度模式选择的因素进行了剖解 ,以期对建立我国的违宪审查制度有所借鉴和启迪。

A Comparative Study on the Judicial Review Systems in the U.S.A.and Germany

The formulation and perfection of constitutional safeguard systems,especially the judicial review system,are necessary in changing constitutional norms into a normative constitution. In this respect,a systematic analysis is made in this paper on the differences between the judicial review systems in the U.S.A. and Germany, especially those in subjects, objects, methods, opportunity and effect. Furthermore, the factors which influence the choice of the judicial review systems in these two countries are examined hereafter to throw light on the formulation of a judicial review system in our country.
