| 摘 要： | 精神损害赔偿是对人身侵害进行精神抚慰的手段,如何掌握损害赔偿的标准和数额,是法学界和司法实践中急需解决的问题。笔者认为,在对精神损害赔偿的数额进行确定时,首先要明确精神损害的赔偿范围,然后在遵循其基本原则的前提下,综合考虑与该精神损害有关的各种因素进行认定。

| Abstract: | Spiritual damage compensation is the means to carry on spiritual conciliation to personal harm. How to grasp the standards and sum of spititual damage is an urgent problem to solve for law circle and juridical practice. The author thinks in the process of confirming the sum of spiritual damage compensation, the first must ensure the scope compensation of spiritual damage, and the next synthetically considers every kinds of factors in the premise of following its basic principles, then ensures the sum. |
