| 摘 要： | 儒家观念对古代中国司法产生了举足轻重的影响,并且直接导致了古代中国程序法治的缺失。在一定程度上,儒家思想依然对当代中国的法治产生着不可忽视的影响,这已成为我国法治发展的一大障碍。法律人特别是法官,必须冲破儒家思想对我国程序法治发展带来的局限,实现对法律及程序的忠诚。

| Abstract: | The Confucius' thoughts have an important influence upon the ancient Chinese laws and are the direct reason for ancient China's lack of procedural legal government.To certain degree,the Confucius' thoughts still have important influence upon modern China's legal government and become a great obstacle for China's legal government development.The people working in the legal circle,especially the judge,should be free from the influence of the Confucius' thoughts to be faithful to the law and legal procedures. |
