| 摘 要： | 志愿服务在我国社会公益事业中发挥着重要作用。但随着志愿服务范围的拓宽，志愿服务中志愿者侵权行为也是客观存在的。志愿者侵权责任的分配应参酌我国民事立法中对其他无偿民事行为的规范，同时考虑志愿服务的特殊性，为推动我国志愿服务的发展，志愿者侵权责任的分配必须符合公平原则和利益风险交互理论。

| Abstract: | The voluntary services play an important role in China’s public welfare.With the development of voluntary services,tortuous actions of volunteers do exist.The allocation of volunteers’ tortuous liabilities should refer to the existing provisions concerning other civil conducts which are without award.At the same time,the particularities of voluntary services shall also be taken into account.In order to promote the development of China’s voluntary services,the allocation of volunteers’ tortuous liabilities has to comply with the doctrine of fareness and the interactive theory of interests and risks. |
