简论自然法学对当前政权建设的启示

基于提高政府服务水平之目的,从政治学理论和实证分析的视角,研究自然法学与政府权力形成之间的逻辑关系,提出政府权力来源于个人权利的让渡、"同意"是合法性的前提以及政府权力必须有序运行三个内在法则,目的是使政府提高对正义、公平的认识,建设真正代表民意的法治国家,并且保证代表民意的法律能够得到如实的执行;限制政府的权力,使公民的自然权利受到宪法的严格保护;以限制政府权力为目的适当分权,并且在横向和纵向两个维度上合理结合。

A Brief Comment of Reflection on the Natural Law for Regime Construction

For serving the government＇s reform,the article studies logical relation of natural law and government power from the view of politics theory and empirical analysis,proposes three intrinsic principle including the government power transferred from the individual right,agree that the government power must be executed orderly.In order to deepen the understanding of fair and justice,country must be constructed under the rule of law,and guarantee the law can represent people truthfully;limiting government＇s authority,and citizen＇s right should be protected under the strict law;dividing power suitably as the goal for limiting the government authority,and should combine reasonably in transvere and the longitudinal.
