当前我国征地风险评估制度初探

在我国目前的法律制度框架下,征地制度将与城市化长期共存,征地制度完善关系到失地农民可持续生计,城镇化进程和社会稳定、地区差距等社会经济发展等重大问题。本文针对现行征地风险评估制度中多以土地管理部门为责任主体,以群众或专家意见作为风险评估结果,在实践中存在评价主体不明、功能定位不清、评价程序不科学等问题,建议从明确征地风险评估定位、完善征地风险评估体系和优化征地评估程序三方面规范征地风险评估制度,建立健全征地冲突风险评估配套机制与监管机制,提高其操作的科学性。

A Preliminary Study on the Risk Assessment System on Land Requisition
