家永三郎诉讼与表现自由

家永三郎因历史教科书审定而起诉文部省的事件,在日本现代史上具有重要影响。我国学者多认为家永诉讼是关于历史认识、教育路线问题与右翼的斗争。事实上,家永三郎成长中深受美浓部达吉独立不阿精神影响,战争期间亲身体验过学术自由受压迫的痛苦,战后积极参与民主化。在1965至1997年长达32年的诉讼中,家永及其辩护团认为教科书审定侵害了公民的教育自由、表现自由,违反了宪法禁止思想检阅的规定,主张审定制度违宪。虽然最终判决中家永主张未得支持,但在促进作为宪法条文的公民自由权利普及贯彻到社会中,发挥了积极作用。
