伦理在法律解释中的作用

法律解释是法律适用中的重要环节,解释的结果直接影响到法律规范与法律事实的对接,也影响到当事人乃至社会公众对法律尊严和法官权威的认同。然而在法律解释过程中,解释者往往会因为种种原因陷入法律解释的客观性与主观性、形式合理性与实质合理性的矛盾之中,导致法律解释结果在适用中出现困境。究其原因,伦理的缺失是重要因素之一。伦理在法律解释过程中,能够影响法律解释主体的价值取向、思维方式、语言表述以及解释方法的选择,从而在一定程度上缓解法律解释中的困境。
