公用企业基本法立法的逻辑证成与基本结构

我国公用企业的市场化改革存在政府和市场的定位失衡、改革目标异化和公用企业的治理困境等缺失,需要有效的制度予以规范。而现行公用企业立法缺乏统一性和权威性、操作性和协调性,不足以作为公用企业市场化改革的制度支撑。因此有必要以公用企业基本法为中心,重构我国公用企业规制立法体系。从理论基础、实践基础、政策和立法基础来看,公用企业基本法立法具有可行性。基本法应当基于公共利益的理念,设立政府责任的多元化、企业治理的利益相关性和企业社会责任的强制性等三项规则。
