略论民事强制执行中不动产查封的方法

由于现行立法关于不动产查封的方法之规定付之阙如,并且由于现行司法解释关于不动产查封方法之确定失之允洽,从而导致不动产强制执行实践中滋生诸多问题。为消弭不动产执行中的弊端,可以借鉴与现行司法解释关于不动产查封方法的规范最为接近的我国台湾地区立法例,统合查封登记与执行法院的直接查封行为,将其作为完整意义上的不动产查封方法。在此基础上,明定执行法院的直接查封行为之实施为查封生效之基准,从而为不动产查封的良性运作奠定基础。

Moreover,the current system of estate-registration should be perfected in order to set up a fine frame of system to guarantee the successful accomplishment of estate-sealing up.
