论土地利用规划的法律效力

土地是珍贵的不可再生资源,合理利用每一寸土地关乎全人类利益。中国目前存在大量严重违反土地规划、浪费土地的问题,造成这一现象存在的原因无疑是多方面的,但法律制度的不健全则是根本原因之一。中国虽规定有土地利用总体规划制度,但自实施以来,法律效力并不明显,没有发挥应有的约束力和强制性。探讨土地利用规划的法律效力,对于经济社会的可持续发展有着重要意义。

Land is a precious,irreclaimable resource,and reasonable use of every inch of land is closely related to interest of the whole human being.At present,there are a lot of problems of seriously violating the land use planning,wasting land in China.Of course,many reasons possibly lead to the problems,but imperfect legal system is one of the essential reasons.Although land use planning has been regulated in China,the legal enforcement is not very strong from the first beginning,and its binding force,compelling force have not been developed.Discussing the legal enforcement of land use planning has a very important significance for the sustainable development of economic society.
