| 摘 要： | 主体既是一个哲学概念,又是法学上的一个重要概念.民事意志既是民法学的基本范畴,又是与民法学其他范畴密切相关的一条主线.在解决民事意志的存在资格问题后,具有单一民事意志的民事主体(自然人、法人和国家)就成为民事意志的载体,也才是真正民法意义上的民事权利主体,这是一个新视角.
