| 摘 要： | 商鞅的法律思想是其变法的重要理论基础,其中突出的"功利主义"和"实用主义"迎合了秦国统治者富国强兵的愿望,反映了新兴地主阶级冲破奴隶制羁绊的政治要求,尤其是他的"重罚"思想,对当时推行新法起到了十分重要的作用,也形成了其区别于其他法家学派的特色。文章探讨了商鞅法律思想的内涵、历史根源及其对我们现代法制建设的启示。

| Abstract: | Shang Yang's legal thoughts were important theoretical basis of his legal reform. Amang them, untilitarianism and pragmatism catered to the Qin ruler's wish of making country rich and building up military power,and reflected new and rising landlord class'political demands for breaking through the bonds of slave-owning system. Especially his severe punishment thought had taken a great effect on practising new law at that time, and had become a characteristic which was different from other school. This paper discusses on the intension and historical origin of Shang Yang's legal thoughts,and its enlightenment to building of modern legal system in China. |
