| 摘 要： | 在工程项目建设的过程中,合同起着十分重要的作用,它是合同双方都必须遵守的标准.本文从合同的定义出发,通过对环境和合同条款本身的研究,提出了合同外围约束和条款约束的概念,进而深入探讨了合同约束体系的情况,研究了合同对当事人的约束,给出了合同约束体系的结构及其建立程序,探讨了从合同约束体系角度识别承包商违约的方法.

| Abstract: | Firstly, we study the contract restrictions which give to the contract parties, and then bring forward the conceptions of outline restrictions and clauses restrictions. Secondly, the system of contract restrictions is set up and the procedure which establishs the system is elicited. Finally, based on the system of contract restrictions we discuss the methods which identify the breach of faith of contractor. |
