论器官捐献人的撤回权

我国的器官移植法规赋予了器官捐献人对其已作出的器官捐献意愿以撤销权，但若从民法理论上对“撤销权”与“撤回权”进行界分，则应称此项权利为“撤回权”。器官捐献的撤回非是使器官捐献不生效力，乃是停止对器官捐献意愿的追求，该项权利的行使只能是捐献主体在其生前或器官植入受体之前通过书面或口头的方式行使。赋予器官捐献人撤回权在于尊重其自我决定权及体现民法所蕴含的价值。器官捐献者行使撤回权后，在活体器官捐献中捐献人恶意撤回致使受体死亡或严重身体损害时需要赔偿损失。
