中国近代扬州民间契约传统与变迁——以房契为例

本文旨在考察在近代大量移植西方法律制度,民间契约生活实践受到了冲击之后,契约文书内容没有保留传统契约的内容,又发生了哪些变化,以及出现这种情况的原因。通过对扬州房契的比较分析,文章认为在建国以前,由于受到传统交易习惯的影响,契约文书基本上保留了传统契约的格式和内容,但也随着国家法的干预加强,略为有了一些变化。

The Tradition and Changes of Civil Contract Practice in the Near Era of Yangzhou

This article analyzes the contract practice of selling house in Yangzhou in the near era of China to see the changes of the civil contract practice in the process of transmitting the modern law from west to east.It also analyzes formation of custom of the tradition of contract and the reasons.The rational and active parts of tradition contract can be adapted to the development of market economy and to meet the requirements of people's cultural life better.
