| 摘 要： | 矿业权能否自由流转是判断其是否成为有效财产权制度的重要标准。矿业权流转应遵循自由流转的原则,同时又应严格流转程序。矿业权的流转应包括出让、转让、抵押、出租、承包、继承这六方面的内容。此外,矿业权的流转也应包括依附于矿业权之上的地质成果;矿业权的流转应建立、健全科学的矿业权评估制度。

| Abstract: | The free exchange of mining rights is an important criterion for judging whether it can become an effective property rights system.The mining rights exchange can stick to the principle of free exchange and follow the procedures of exchange. The mining rights exchange should include remise,transference,mortgage,hire, contract and inheritance.In addition,the exchange of mining rights should also include the geological achievements attached to the mining rights.The system of sound and scientific assessment of mining rights should be set up concerning the exchange of mining rights. |
