我国成年人监护制度缺陷与立法建议研究

以历史与逻辑相统一的方法，科学地分析了我国成年人监护制度的缺陷。主要表现在：立法观念上的滞后、立法体例上有违民法自身的逻辑性、内容上的不足等。同时提出了完善我国成年人监护制度的立法建议，即，成年人监护理念的纳新；立法体例的完善；扩大我国成年人监护制度适用的范围；引入任意监护制度，完善监护的设立方式；根据行为能力的不同设置不同层次的监护；具体规定成年人监护事务的内容，明确监护人的权利、义务，强化监护人的责任等。
