南北知识产权保护：利益失衡及其利益平衡之重构

当代的知识产权国际化趋势越来越明显。南北国家之间在科技、经济和文化发展方面的巨大差异使得国际知识产权保护存在明显的利益失衡现象。知识产权保护的不均衡性反映了知识产权领域中的特殊国际关系。发展中国家在知识产权国际保护中应当极力维护自己的利益，打破发达国家对知识产权保护的垄断和利用知识产权获得不正当利益，以重构国际社会的知识产权利益平衡机制。我国知识产权在推进国际化的潮流中也应从国家和民族利益大局出发，对知识产权保护给予适当的定位。

The trend of internationalization of intellectual property in modern society is more and more obvious.There exist obvious interests in respect of intellectual property protection owing to the great gap between the developed countries and the developing countries in area o science and technology,economy and culture.The unbalanced nature embodies the special international relationship.The developing countries shall safeguard their interests in the international protection of intellectual property and break through the monopoly through intellectual property protection and the acquirement of unfair interests by developed countries,so as to establish the mechanism of balancing of intellectual property in the level of international society.In the course of advancing the trend of internationalization of intellectual property,China shall also have appropriate fixation as to the protection of intellectual property according to national interests and nationality as well.
