公民参与行政决策研究——以电动自行车事件为例

电动自行车事件反映了我国转型期各种不同的利益冲突,折射出我国行政决策过程中公民参与机制的缺失。公民参与是现代行政民主的必然要求,可以为行政机关提供各种信息,促使行政机关在作出政策选择时考虑相关因素,为行政决策的民主性与正当性提供程序基础,并通过程序民主提高行政决策的可接受性。尽管我国目前相关制度尚不完善,但是依然存在保障公民参与行政决策的制度空间。

On Citizen's Participating in Administrative Decision- making——Taking the Affair of Electric Bicycle for Example

The affair of electric bicycle reflected the conflict of various benefits in the process of social transformation and reflected the deficiency of the mechanism of citizen's participating in the process of administrative decision-making.Citizen's participation is necessary for modern administrative democracy.It can provide the democratic procedure for the government to collect different information and to weight all factors.Furthermore,it is also the basis of procedural justice for the democracy and legitimacy of administrative policy and can elevate the acceptability of the policy.Although the institutions of China are not perfect at present,there are measures to protect the right of citizen's participation.
