| 摘 要： | 权利保障是现代法的功能取向,通过法律的权利保障就是通过法律的权利确认、义务承担和责任的追究机制保障权利的实现,权利的法律保障包括权利的形式保障、实体保障和程序保障三种类型。权利保障是现代法律运作与发展的轴心,现代法律的发展史就是一部权利保障的历史。

| Abstract: | Right protection,undoubtedly,is the main goal after which modern law is pursuing.Upon the provisions in respect of affirming right,assuming obligation,and bearing liability,right protection afforded by law means achieving one's right.Also,right protection carries three categories which include format protection,substantial protection,and procedural protection.In author's opinion,right protection is the hub on which modern law is based,and consequently the history of modern law is equivalent to that of right protection. |
