| 摘 要： | 美国<犹他州数字签名法>是一部具有划时代意义的电子商务立法.它的突出特点之一是创设了"建议的信赖限度"的制度.此制度的出台,降低了认证机构的经营风险,限制了认证机构在出现损害赔偿时承担的责任,十分有利于认证机构及电子商务的发展.我国的电子商务立法应借鉴建议的信赖限度的制度,并增加对建议的信赖限度作最低金额的强制性规定,及认证机构故意侵权时不受建议的信赖限度限制的规定,并以保险制度作为建议的信赖限度的辅助性制度.

| Abstract: | The Utah Digital Signature Act is a legislation of great significance. One of its outstanding points is that it establishes the recommended reliance limit. It reduces the business risk of certification authority, and limits the liability of certification authority when damage arises, which promotes the development of certification authority and electronic commerce. However, it also includes some flaws. Nevertheless the recommended reliance limit can provide some help to electronic commercial legislation in our countries. |
