企业社会责任层次观及其法律制度的构建

企业的社会责任可分为经济责任、法律责任和道德责任三个层次 .当前,我国企业社会责任在担责和立法现状方面都存在着比较突出的问题.考察国外企业承担社会责任的立法情况及实践,我国应尽快从经济责任、法律责任和道德责任三个层次上构建和完善企业承担社会责任的法律制度.在构建过程中,政府应发挥主导作用,企业社会责任标准的制定必须完整、严谨并强制执行,三个层面应分别侧重于企业自身的履行;政府的强制性规范;社会的宣传、引导和激励机制.
