借用车辆肇事出借人责任的承担

针对借用车辆肇事时出借人是否应当承担责任、若承担责任应适用何种归责原则及应当承担的是连带责任抑或是按份责任等诸多疑问,在法律法规缺乏明确规定的情况下,学界说法各异,各地司法机关的做法更不相同。本文在对各种说法和做法进行逐一梳理的基础上,探讨了侵权责任的归责原则,并结合对《人身损害赔偿解释》相关规定的解说,提出借用车辆肇事时出借人应当承担的是按份的过错责任。

Lender's Responsibility When Traffic Accident Happens to the Lended Vehicles

There are no laws and regulations on whether the lender should undertake the compensation responsibility and what responsibility principle should be applied if the lender undertakes the compensation responsibility,respective responsibility or joint responsibility he should take,when traffic accident happens to the lended vehicles.Experts have different views and the court adopts different procedures.In my opinion,the lender should undertake respective responsibility if he has mistakes.
