宅基地权属观念的地方性建构——基于皖北S村宅基地制度实践的分析

农村建设用地的用途管制规定了农民宅基地所有权的集体属性，而在具体的产权实践中，农民对宅基地的产权认知越来越趋向于私有化。宅基地产权的地方性建构意味着对土地产权的讨论必须进行“在地化”的理解，S村宅基地制度的在地化实践以及土地管理权的上收为农民提供了富有弹性的私人化实践空间。同时，基于地方性共识的农民宅基地需求同该制度空间相耦合，共同形塑了农民对宅基地属性的私化认知。

Local Construction of the Cognition of the Homestead Ownership---Based on the Analysis of S Village Practice in the Homestead System in Northern Anhui

The management of the rural construction land provides for the collective ownership of the farmers ’ homestead ,however ,there is a growing view that it is a private product in the specific rural practice .The local construction of the homestead ownership means that we must understand homestead ownership based on the local practice ,such as the understanding of “on the ground”.The localized practices about the homestead system and the land management system provide flexible personalized practice space for peasants ,Meanwhile ,homestead demand of peasants based on the local consensus coupled with the institutional space ,all the elements jointly shape the pri-vate cognition of homestead ow nership .
