论土地征收中宅基地使用权的补偿

我国现行国家层面立法对宅基地使用权征收补偿没有规定。实践中各地对宅基地使用权是否予以征收补偿做法不一，并在不同程度上损害了宅基地使用权人的利益。建议：在立法上明确规定宅基地使用权的补偿；以土地出让金为基础制定合理的宅基地使用权补偿标准；对相关法律法规出台前形成的宅基地应本着尊重历史与事实原则进行补偿；在房屋安置、自拆重建等非货币补偿中要注意补偿宅基地使用权的损失。

On Compensation for Homestead Land Use Right During Land Expropriation

China’s current national legislation has no provisions on compensation for the homestead land use right during the expropriation .In practice ,w hether or not to impose expropriation compensation for the homestead land use right is different in various regions ,which harms the interests of the people with homestead land use right in varying degrees .It is recommended that ：in the legislation ,the compensation for the homestead land use right shall be clearly stipulated ;based on the land transferring fees ,rational homestead land use right compensation standards should be developed ;compensation shall be made based on the principle of respecting the history and the fact for the homestead built before the introduction of the relevant laws and regulations ;for non-monetary compen-sation for homestead placement or demolition and reconstruction ,one should pay attention to compensation for the loss of the homestead land use right .
