社会保障中的法律正义观及其实现

正义是衡量法律善恶的标准,法律主要通过分配权利的方式来确立正义,体现正义的基本要求。社会保障是对社会劳动成果的再分配,是社会可持续发展的稳定器、减压阀,暗合法律正义的基本精神。中国一直实行城乡分割的社会保障制度,给予农民一种歧视性的待遇,不符合宪法的相关规定,农村社会保障层次低,主要依靠生育儿女养老,国家生育政策难获认同,产生很多社会问题,社会保障制度难以发挥稳定器的作用。赋予农民完整的公民权,实行城乡一体的社会保障制度,既是时代的呼唤,也是法律正义的要求。

Justice is the standard to measure a law.The law parts the rights to establish justice.Social security is the second distribution of social fruit and acts as a stabilizer in the social development,so social security coincides the essential spirits of the law.China has carried out a illegal separating social security system which gave the peasants a discriminating treatment.The peasants have to rely on their when they get old.The family planning policy is not well accepted by the peasants.Carrying out a single social security system and giving the peasants entire civil rights is demanded by not only the social development,but also the law justice.
