论我国网络著作权的法律保护

作为一种新兴的媒体,互联网已成为一种不容忽视的传播方式。由于互联网发展速度太快,对于此种新兴事物的法律保护捉襟见肘。在网络立法尚不成熟的今天,许多网站往往只能通过加密、防火墙、入网控制、访问控制等安全技术手段来加强对自身网络资源的保护和管理。但采用技术手段在给用户带来不便的同时,其本身也并非坚不可摧。网络环境下如何保护著作权便愈显迫切。鉴于此,只有不断地完善网络立法,通过法律手段来保护网络作品的著作权,才是解决问题的根本办法。立足于我国网络著作权立法滞后的现状,以我国现行的《著作权法》为根据,对有关网络著作权的法律保护问题提出了若干思考,以求能有效促进网络信息行业的健康发展。

On Legal Protection of Network Copyright in China

As a kind of young medium,Internet has become a transmission method that cannot be overlooked.Since its quick development,the legal protection to this new thing has lagged.Nowadays,because of the immaturity of network legislation,many websites can only enhance the protection and management of their own network sources through the safety techniques,such as encryption,firewall and accessing control.However,these techniques have brought much inconveniency to users and are not strong enough to protect network safety.How to protect copyright under network environment has become more and more imperious.Hence,only through perfecting the network legislation and using legal methods to protect the copyright of cyber works,these problems can be completely solved.Based on the status quo of the lag in legislation of network copyright and the present copyright law in China,this paper gives some thoughts on the legal protection of network copyright for promoting the healthy development of network information industry effectively.
