我国碳交易法律规制研究

目前仅《京都议定书》第12条所确立的清洁发展机制CDM是适用于我国的碳交易机制.我国目前规范碳交易市场的仅有少量的部门规章、部门规范性文件、地方规范性文件,尚无真正意义上规范我国碳交易市场的高层次的法律.作为一种新型交易形式,我国目前对碳交易及其法律规制的研究并不深入.依实践之需,我国现行碳交易法规政策应当改变以政策为主的规范形式,确定碳排放交易法律规制基本框架；以强制性立法的方式将自愿交易纳入规制对象,并完善配套相关政策、法制,切实促进碳交易发展.

Legal Study of Carbon Trade in China

The CDM framework for clean development based on item 12 of Kyoto Protocol applies to China’s carbon trade.In China’s carbon trade market,there exist few industry regulations and administrative documents.There is no fundamental law that regulates the carbon trade market in China.There is also lack of studies in terms of laws and regulations of this new type of trade.There is an urgent need to set up a legal framework guiding the practice of carbon trade,instead of policy-oriented guidelines.Mandatory laws are to be made to cover voluntary trade so as to guide policy making and promote the development of carbon trade.
