| 摘 要： | 本文在考察商标平行进口理论与实践发展状况的基础上,从商标法与保护消费者权益、反不正当竞争法以及贸易政策三个角度进行分析,认为我国立法应明确规定允许平行进口,但对平行进口商故意的“搭便车”行为则应予禁止。

| Abstract: | With China's entry into WTO and the further development of foreign trade,there are more and more cases on parallel importation of trademark products.But there has no relative law that can deal with such cases in China now. After a survey of the latest development of the theories and practice in different countries,suggestion legislature is proposed. |
