| 摘 要： | "百事可乐诉雷德蒙德"案确立了商业秘密保护中"不可避免披露"原则."不可避免披露"原则的三个规定性要素是离职员工必须知悉或有理由知悉原雇主的商业秘密、离职员工在新工作中将不可避免地"披露"原雇主的商业秘密、该离职员工的新旧雇主间存在竞争关系."不可避免披露"原则内在地要求采用禁令这一救济方式,但在禁令的内容设计上应尽可能维持平衡.
